CoachingArea GmbH is responsible pursuant to Article 4(7) of the EU General Data Protection Regulation (hereinafter always "GDPR"). If you contact us by e-mail or via a contact form, the information you provide (your first and last name as well as your email address) will be stored by us in order to answer your questions. We delete the required data in this area as soon as it is no longer necessary, or we restrict processing if there are legal retention obligations. If we use commissioned service providers for certain functions of our offer or would like to use your data for advertising purposes, we will inform you in detail about the relevant processes below. We also mention the specified requirements for the storage period.

Collection of Personal Data when visiting our Website

If you use the website for information purposes only, without registering or providing us with additional information, we only collect personal data that your browser transmits to our server. We collect the following data when you want to visit our website to help us technically ensure the stability and security of our website (legal basis are Art. 4 No. 1 & Art. 6 para. 1 p. 1 lit. f GDPR):

The IP address, the access status/HTTP status code, the date and time of the request, the time zone difference to Greenwich Mean Time (GMT), the language, the content of the request (specific page), the website from which the request originated, the amount of data transferred, the browser and the version of the browser software and the operating system incl. its interface are included.

Hosting

We use the cloud deployment platform Vercel (Vercel Inc. 340 S Lemon Ave #4133 Walnut, CA 91789, USA; "Vercel). We have entered into a commission processing contract with Vercel in accordance with Art. 28 GDPR. Our contract with Vercel also includes the EU Standard Contract Clauses (SCC), which guarantees data protection in accordance with EU directives. Through Vercel, this website is hosted via the external service provider Amazon Web Services ("AWS").

The hosts servers store personal data collected on this website. This may include, for example, IP addresses, contact requests, meta and communication data, contract data, contact details, names, website accesses and other data. We use the host to fulfil our contractual obligations to potential and existing customers (Art. 6 (1) (b) GDPR) and to ensure a secure, fast and efficient provision of our online offer by a professional provider (Art. 6 (1) (f) GDPR). Our hoster will only process your data to the extent necessary to fulfil its service obligations and will follow our instructions regarding this data.

Our servers are located in Frankfurt am Main, Germany. However, AWS also processes your information in the USA, among other places. AWS has implemented rules to comply with international data transfer. These rules apply to all activities around the world where AWS processes personal data of EU citizens. These measures are based on the clauses of the EU Standard Contract (SCCs). AWS is committed to complying with the European level of data protection when processing your relevant data, even if the data is stored, processed and managed in the US. Use of Brevo

Brevo (Sendinblue GmbH, Köpenicker Straße 126, 10179 Berlin, Germany; "Brevo") is used by this website to send emails and newsletters and to provide important news about the platform. Brevo is a service that makes it possible to organise and analyse the sending of emails and newsletters. The information you have entered to receive newsletters, such as your email address, is stored on Brevo's servers.
We can analyse the behaviour of newsletter recipients based on our newsletters and emails sent with Brevo. It is possible to investigate, among other things, how many readers read the newsletter message and which link in the newsletter was clicked on frequently. All links in the email are tracking links that are used to count the number of clicks you make.

You must unsubscribe from the newsletter if you do not want any analysis from Brevo. We provide a suitable link in every newsletter message. You also have the option to revoke your consent at any time by sending an email (to: data@coachingarea.net) to the data protection officer indicated in our imprint.

The information that you have left with us for the purchase of newsletters will be stored by us until you unsubscribe from the newsletter and will then be deleted from both our and Brevo's servers. Data stored by us for other purposes, such as email addresses for the members' area, will not be affected by this circumstance.

If you voluntarily contact us by email or live chat, we will receive personal information such as your email address and possibly your name. In the course of fulfilling or initiating a contract, we provide these means of contact in order to respond promptly to enquiries. The information is not shared with anyone else.

Use of Hubspot

We use the customer relationship management system from HubSpot Inc (25 First Street, 2nd Floor Cambridge, MA, USA; "Hubspot"). The software company HubSpot originates from the USA and has a branch in Ireland. The branch is located at Ground Floor, Two Dockland Central, Guild Street, Dublin 1, Ireland.

Hubspot is used as a CRM system to manage the contact details of our customers and potential new customers. The purpose of processing your data is to engage with you and provide you with relevant information about our products. This enables us to communicate effectively during our sales activities and to find new business opportunities. The following personal data is collected, processed and stored: Name, title, email, telephone, role, organisation/club/company.

If necessary, only certain users can use the database to search for business information about customers and potential new customers, to contact new/customers by e-mail or telephone or to process support enquiries. Hubspot only uses the personal data for technical processing and does not pass it on to third parties. Our legitimate interest in carrying out sales activities in accordance with Art. 6 para. 1 lit. f of the GDPR leads to the processing of your personal data. As a processor, Hubspot acts exclusively in accordance with our instructions. Use of Podbean

Our podcast is hosted by the provider Podbean, which is operated by Podbean Tech LLC, USA (135 Madison Avenue, 5th Floor, New York, NY 10016, USA). When you use our podcast via Podbean, technical data is automatically collected, such as your IP address, the browser used, the operating system, the URL you visited previously and the time of access. This data is stored in so-called server log files.

In addition, Podbean may collect data about your use of our podcast, such as which episodes you listen to, how long you listen to them and from which device or location you access our podcast. This data is used to provide and optimise our podcast offering.

Use of our Platform

If you wish to use our Platform, you must register using your email address and a password of your own choosing (without using Facebook or Google Connect as set out in clause 17). For registration, we use the so-called double-opt-in procedure, which means that your registration is only completed when you have previously confirmed your registration via a confirmation email sent to you by clicking on the link contained therein. If your confirmation is not received within 24 hours, your registration will be automatically deleted from our database. It is necessary to provide the above information, you can disclose further information voluntarily.

If you use the platform, your data may be made available to other participants of the platform in accordance with the contractual performance. Information about you will also be visible to users without a profile. Depending on whether you have provided it, the following information about you will be visible: Your name, phone number, email, the name of the club/event organiser, the website of the club/event oragniser, the venue incl. address and information about your participating teams (team name, age group, playing strength, gender, inclusion team).

To prevent illegal access to your personal data by third parties, the connection is encrypted using SSL technology.

If you use our platform, your data required for the performance of the contract will be stored until you permanently delete your access. The basis of the right lies in Art. 6 para. 1 p. 1 lit. f of the GDPR. Unless you delete this voluntary data beforehand, it will be stored during your use of the platform. You have the possibility to monitor and change all information in the protected customer area (profile page/settings).

Login with Google or Facebook Connect

You can log in to our app with your access data if you are already registered with Facebook or Google. In this case, no additional registration with us is required.

You will be redirected to the Facebook or Google website to enter your usage data and log in. This action links their profile on Facebook or Google to our application. After conclusion of the contract, the data will initially be stored for the duration of the warranty period, then stored taking into account statutory retention periods, in particular retention periods under tax and commercial law, and then deleted unless you have consented to further processing and use.

Rights of the Data Subject

If the legal requirements are met, data subjects have the right to information, rectification, erasure, restriction of processing and data portability in accordance with Art. 15 to 20 of the GDPR.
In addition, you have the right to object to processing pursuant to Art. 21(1) of the GDPR against direct marketing pursuant to Art. 6(1)(f) of the GDPR.

Rights of Objection

If the above-mentioned personal data processing is carried out on the basis of our legitimate interest pursuant to Art. 6 (1) (f) of the GDPR, you have the right to object to such processing with effect for the future in the case of a specific situation.

After objection, the processing of the data concerned will be terminated unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves to assert, exercise or defend legal claims.

Right of Complaint to the Supervisory Authority

If you believe that the processing of your personal data is not lawful, you have the right to lodge a complaint with the supervisory authority in accordance with Article 77 of the GDPR.
